Terms of Service

Welcome to Monit (the "Service" or "Monit"), an online service for tracking work hours, managing clients and projects, and generating billing documents, intended for freelancers and the self-employed. These Terms of Service (the "Terms") govern your use of the Service, alongside the Privacy Policy. Using, registering for, or accessing the Service constitutes full acceptance of these Terms. If you do not agree to the Terms, you may not use the Service.
Beta Stage
The Service is in beta and is provided on an "as-is" and "as-available" basis. At this stage the Service may change, be updated, or be limited from time to time, and may contain faults, downtime, or errors. We do not guarantee any service level (SLA), full data retention, or that any particular feature will continue to exist. Using the Service during the beta stage is at your own risk.
User Account and Eligibility
- The Service is intended for users aged 18 and over who are competent to enter into a binding agreement.
- You must provide true, accurate, and up-to-date information when registering, and keep it current.
- You are solely responsible for keeping your login credentials confidential and for all activity carried out under your account.
- You must notify us without delay of any unauthorized use of your account or any suspected breach of its security.
Permitted Use
In using the Service, you undertake not to:
- Use it for any unlawful, infringing, or harmful purpose.
- Attempt to harm or disrupt the Service, or gain unauthorized access to the system, to accounts, or to other users' data.
- Place an abnormal load on the Service, or use it in an automated manner inconsistent with reasonable and fair use.
- Copy, reproduce, reverse-engineer, or sell any part of the Service without express written permission.
The Documents Generated by the Service Are Not Tax Documents
The documents the Service generates, including the settlement statement and PDF files, are an internal summary for convenience only that aggregates hours and billable items. These documents do not constitute an invoice, a tax invoice, a receipt, or any lawful accounting document, and may not be treated as a substitute for one. Responsibility for issuing lawful tax documents, keeping books, reporting to the authorities, and complying with all tax, regulatory, and legal obligations applicable to you rests with you alone. The Service is not responsible for the content of the charges, the amounts, the calculations, or any use you make of the documents it generates.
No Professional Advice
Nothing in the Service, its content, or the documents it generates constitutes tax advice, accounting advice, legal advice, or any other professional advice, and you may not rely on them as such. For any professional matter you should consult a qualified professional.
Your Data and Backup Responsibility
The data you enter is owned by you. We process it solely to provide the Service, in accordance with the Privacy Policy. You may export or delete your data at any time from your account settings. Since the Service is in beta, you are responsible for keeping an independent and up-to-date backup of important data, and we will not be liable for any loss of data for any reason whatsoever.
Intellectual Property
All rights in the Service itself, including the design, the code, the trademarks, and the content, are reserved to us. These Terms grant you a personal, limited, non-exclusive, and non-transferable license to use the Service only, and do not grant you any right in the Service's intellectual property.
Pricing and Future Changes
During the beta stage, use of the Service is free of charge. We intend to continue allowing the management of up to three clients free of charge going forward. We reserve the right to add paid plans or features for extended use in the future, to change the pricing model, or to limit certain features. Any such change will take effect only after advance notice and within a reasonable timeframe. You will not be charged without your express prior consent.
Service Availability
We strive for high availability but do not guarantee continuous, available, or fault-free operation. We may update, change, disable, or discontinue the Service or parts of it from time to time, including for maintenance purposes, and will endeavor to provide advance notice of material changes.
Limitation of Liability
The Service is provided "as is" and without warranty of any kind, express or implied, including any warranty of fitness for a particular purpose, availability, accuracy, or non-interruption. To the maximum extent permitted by law, we will not be liable for any indirect, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, or data, arising from the use of the Service or the inability to use it. In any event, our total aggregate liability for any cause whatsoever will not exceed the amount you actually paid for the Service in the twelve months preceding the event, and during the beta stage, in which the Service is provided free of charge, that amount is zero.
Indemnification
You undertake to indemnify and compensate us for any damage, expense, or liability, including reasonable attorneys' fees, caused to us as a result of your use of the Service in breach of these Terms or the law, or as a result of a third-party claim arising from your use of the Service or from the data you entered into it.
Third-Party Services
The Service relies on external infrastructure providers (including storage, hosting, and login services). We are not responsible for faults, service interruptions, or damages arising from the operation of these providers, who are subject to their own terms and privacy policies.
Force Majeure
We will not be liable for any delay or failure to perform our obligations arising from circumstances beyond our reasonable control, including communications or power failures, faults at infrastructure providers, cyberattacks, war, a state of emergency, or an order of a competent authority.
Suspension and Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your account, immediately and at our discretion, if you breach these Terms, if your use harms the Service or other users, or if required by law.
Changes to the Terms
We may update these Terms from time to time. In the event of a material change, we will update the revision date and provide notice as needed. Continued use of the Service after the Terms are updated constitutes acceptance of the updated Terms.
General Provisions
- If any provision of these Terms is found to be invalid, the remaining provisions will continue in full force.
- Failure to enforce a right under these Terms will not be deemed a waiver of it.
- You may not assign your rights under these Terms without our prior written consent.
- These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
Governing Law and Jurisdiction
These Terms are governed solely by the laws of the State of Israel, and exclusive jurisdiction over any matter relating to them is vested in the competent courts of the Tel Aviv-Jaffa district.
